Printing Terms for Printed Cookbooks

These Printing Terms ("Printing Terms") form a supplementary agreement between you (the "Creator" who enables printing for others, or the "Buyer" who orders a printed copy, as the case may be) and DK Tech Solutions UG (haftungsbeschränkt), Schwanthalerstr. 141, 80339 München, Germany ("BiteSnap", "we", "us") in addition to our Terms of Service. They apply whenever a physical printed copy of a BiteSnap cookbook is ordered through the app. Printed copies are produced and shipped by our third-party print partner [PRINT_PROVIDER_PLACEHOLDER] ("Print Partner"). Please read these Printing Terms carefully before enabling printing for a cookbook or placing a print order.

1. Scope and Acceptance

These Printing Terms supplement our general Terms of Service, Privacy Policy and (for paid cookbooks) Creator Terms. A Creator accepts these Printing Terms whenever they enable "Printing for others" for a cookbook. A Buyer accepts these Printing Terms whenever they place a print order. In case of conflict between these Printing Terms and our general Terms of Service with respect to printed cookbooks, these Printing Terms take precedence.

2. Print Partner

Printed cookbooks are produced and fulfilled on behalf of BiteSnap by [PRINT_PROVIDER_PLACEHOLDER]. [PRINT_PROVIDER_PLACEHOLDER] is an independent third party and handles printing, binding, packaging and delivery. BiteSnap may change the Print Partner at any time with reasonable notice. Production specifications (paper stock, binding, format, color profile) are determined by the current Print Partner and may change over time.

3. Contractual Parties for a Print Order

The contract for a printed copy is concluded between BiteSnap and the Buyer when BiteSnap confirms the order (the order confirmation email). BiteSnap in turn engages the Print Partner to produce and ship the copy. The Creator is not a contractual party to the print order between BiteSnap and the Buyer, but is bound by these Printing Terms with respect to the content provided for printing.

4. Creator Rights, Warranties and Acknowledgement

A Creator who enables printing for others represents and warrants that they: (a) own or have obtained all rights, licenses, consents and permissions required to have the cookbook reproduced in printed form and sold to third parties in all territories in which BiteSnap offers printing; (b) have obtained the consent of any person depicted or quoted in the cookbook for their likeness, voice or statements to be reproduced in a printed, commercially distributed product; (c) have the right to grant BiteSnap and its Print Partner the sub-license below; and (d) will not enable printing for any content that infringes third-party rights or violates these Printing Terms, our Terms of Service or our Community Guidelines. By enabling printing for others, the Creator grants BiteSnap and its Print Partner a worldwide, non-exclusive, sub-licensable, royalty-free license to reproduce, format, pre-press, print, bind, package, distribute and deliver the cookbook content as printed copies, and to retain reasonable production records as required by law. The Creator will indemnify BiteSnap against any third-party claims resulting from a breach of these warranties.

5. Content as Printed

Printed copies reflect the cookbook content at the moment of order. Subsequent edits, deletions or content removals by the Creator do not affect copies that have already been produced or shipped. Neither BiteSnap nor the Print Partner is obliged to recall, reprint or replace copies because of later content changes, except where required by law (for example to remove unlawful content).

6. Creator Share for Printed Sales

Where the cookbook is a paid offering and the Creator has enabled printing for others, the Creator is entitled to a share of the net margin of each printed sale, after deduction of (a) production cost charged by the Print Partner; (b) shipping and handling; (c) applicable taxes (including VAT) collected from the Buyer; (d) payment processing fees; and (e) any refunds, chargebacks or returns attributable to that sale. The applicable Creator share percentage, minimum payout threshold, and payout schedule are displayed to the Creator in the BiteSnap app and otherwise follow the Creator Terms. No Creator share is owed in respect of copies the Creator orders for themselves.

7. Pricing, Taxes and Shipping

The price displayed to the Buyer at checkout is the final price and, in jurisdictions where required, includes value-added tax, sales tax or goods-and-services tax as applicable to printed books in the relevant territory. Shipping and handling costs are shown separately at checkout. Prices may vary by format, page count, paper stock, destination country and time of order. We may change prices at any time; changes do not affect orders already confirmed.

8. Order Process and Confirmation

A print order becomes binding only when BiteSnap has sent an order confirmation by email. Prior communications (for example the preview in the app or the order summary on the checkout screen) are not binding order confirmations. BiteSnap may refuse or cancel orders for reasons including (a) technical errors in the listing or pricing; (b) suspected fraud, chargeback risk or sanctioned destinations; (c) content concerns flagged during pre-press; or (d) capacity constraints of the Print Partner. In such cases, any amount already charged to the Buyer will be refunded in full without undue delay.

9. Production and Delivery Times

Printed cookbooks are produced on demand. Delivery times consist of a production lead time at the Print Partner plus shipping time to the destination address. The indicated production and delivery times are estimates only and are not binding, unless a specific delivery date has been agreed in writing. Delays caused by force majeure, customs clearance, or inaccurate delivery details provided by the Buyer are not attributable to BiteSnap.

10. Right of Withdrawal and Exception for Personalised Goods

Consumers resident in the European Union have a statutory right to withdraw from distance contracts within 14 days (§§ 312g, 355 BGB). However, printed cookbooks ordered through BiteSnap are produced on demand and individually printed on the basis of the content and configuration selected by the Buyer at the time of order. As such, they qualify as goods that are made to the consumer's specifications or clearly personalised within the meaning of § 312g Abs. 2 Nr. 1 BGB, and the statutory right of withdrawal does not apply to them. The Buyer will be made aware of this exception before placing the order. This exception does not affect any statutory warranty rights in case of defects (see Section 11).

11. Defects, Returns and Warranty

The statutory warranty rights of the Buyer under German law (§§ 434 ff. BGB) remain unaffected. If a delivered printed copy has a material defect (for example printing errors, binding defects, incomplete pages, damage during shipping), the Buyer must notify BiteSnap within a reasonable time via contact@bite-snap.com, providing the order number and photos. BiteSnap will, at its option, arrange a free replacement copy or a refund. Minor variations in color, paper shade or trimming that are within the Print Partner's standard tolerances do not constitute a defect.

12. Prohibited Content

Creators must not enable printing for, and Buyers must not attempt to order, content that (a) infringes third-party intellectual property, publicity, privacy or personality rights; (b) is unlawful, defamatory, discriminatory, sexually explicit involving minors, glorifies violence or terrorism, incites hatred, or otherwise violates our Community Guidelines; (c) contains personal data of third parties without a lawful basis; or (d) is misleading with respect to ingredients, allergens or health claims in a way that could endanger consumers. BiteSnap and the Print Partner may refuse to produce, halt or destroy printed copies that violate this section and may block Creator accounts and Buyer accounts accordingly.

13. Data Protection

To fulfill your print order, BiteSnap shares the necessary order and shipping data with the Print Partner, who processes this data as a processor (Auftragsverarbeiter) on behalf of BiteSnap. Please see our Privacy Policy for details.

14. Limitation of Liability

BiteSnap is liable only for damages caused by intent or gross negligence, and for breach of material contractual obligations ("Kardinalpflichten"); in the latter case, liability is limited to damage that is typical and foreseeable for this type of contract. This limitation does not apply to mandatory statutory liability (for example under the German Product Liability Act) or to damages arising from injury to life, body or health. BiteSnap is not liable for inaccuracies, errors or omissions in the Creator-supplied content of the printed cookbook, including incorrect ingredient or allergen information; such liability rests with the Creator as between BiteSnap and the Creator.

15. Changes to These Printing Terms

BiteSnap may change these Printing Terms at any time with reasonable notice. The version in force at the time a print order is placed or a cookbook is enabled for printing applies to that order or enablement.

16. Governing Law and Jurisdiction

These Printing Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection rules in the Buyer's country of residence remain unaffected. If the Buyer or the Creator is acting as a merchant (Kaufmann), a legal person under public law, or a special fund under public law, or has no place of general jurisdiction in Germany, the exclusive place of jurisdiction is Munich, Germany.
